Supplemental Terms for “SOW Discount”

These Supplemental Terms apply to the “SOW Discount” (the “Discount”) offered through BAM! Augmented Media. They are in addition to the BAM! Augmented Media Terms & Conditions and the Baseline Giveaway Terms. In the event of a conflict, these Supplemental Terms control.

1. Sponsor

The Discount is sponsored by the entity identified in connection with the specific promotion (“Sponsor”). When SwiftKick Mobile is the Sponsor, it assumes full responsibility for administering the Discount in accordance with these Supplemental Terms.

2. Eligibility

• Open only to individuals or entities who enter into a first paid Statement of Work (SOW) with the Sponsor.
• Intended exclusively for new paying customers of the Sponsor.
• Void where prohibited.

3. Discount Terms

• The Discount applies only to the first SOW executed between the customer and the Sponsor.
• The Discount will be applied to all invoices issued under that first SOW.
• The Discount does not apply to:
  • Any subsequent SOWs, whether or not they relate to the same project.
  • Renewals, extensions, or add-ons executed as new SOWs.
• Each SOW is treated as a separate engagement for the purposes of this Discount.

4. Limitations

• The Discount has no cash value, is non-transferable, and may not be applied retroactively.
• Discounts cannot be combined with any other offers, promotions, or discounts, unless expressly permitted by the Sponsor.

5. Sponsor’s Discretion

The Sponsor reserves the right to deny or revoke the Discount in cases of misrepresentation, abuse, or suspected fraud.

6. Limitation of Liability

The Sponsor’s liability with respect to the Discount is limited solely to the value of the Discount as described.
